Tennisist Privacy Policy

This Privacy Policy («Privacy Policy») describes how Tennisist Inc. («Company») collects, uses, stores and discloses information received from users (individually, the «User» and collectively, the «Users») of the mobile application Tennisist («Mobile Application»).

All Users must be registered with the Mobile Application. Only persons who complete registration can use the Mobile Application. By registering with the Mobile Application, Users (including you) agree to the Privacy Policy.

User information includes personal data. All terms of this Privacy Policy relating to the User’s information apply equally to the User’s personal data. The terms of this Privacy Policy, which specifically regulate personal data, refer only to the personal data of the User.

The company can use the services of third parties to collect, process, analyze, use, store and disclose User information. In this case, the terms of the Privacy Policy will also apply to third parties.

User information expressly excludes materials such as photographs or any other images, uploaded by the Users to the Mobile Application. These materials are not considered private or confidential. These materials are regulated by the Terms of Service.

1. Information provided by the User

The User provides information to the Company manually by filling in the required fields during registration and also automatically through the User`s mobile device.

When registering, the User provides information by completing the fields in the User’s account («Account»). This information is visible to other Users and is necessary for the full use of the Mobile Application.

In addition, the User’s mobile device automatically provides the Company with information about the type of device, IP address, and country of the User. The Company also receives information about all actions of the User within the Mobile Application.

The User can also provide information to the Company through third-party communication tools.

2. Personal data of the User

Some of the User’s information may be personal data. By registering in the Mobile Application, the User decides to provide personal data and expressly agrees to its processing by User`s own decision and in User`s interest, while such consent of the User is informed and acknowledged.

The User understands and agrees that all personal data specified in the User`s Account will be visible to all Users of the Mobile Application. Confidentiality does not apply to personal data specified by the User in the Account.

With respect to all other personal data not specified by the User in the Account but provided by the User to the Company in other ways, its confidentiality is preserved; under no circumstances it will be distributed or provided to third parties without the User`s consent, except when such disclosure is required by the law.

Acceptance of the terms of this Privacy Policy, including provisions regarding the processing of personal data, is carried out by a consent mark at registration. Consent to the processing of personal data can be revoked by the User at any time by sending an email to the Company’s technical support at info@tennisistapp.com. If the User withdraws consent to the processing of personal data, the Company will delete the User’s personal data and will not have the right to use it in the future. In this case, the Account of this User will also be deleted due to the impossibility of using the Mobile Application without certain personal data of the User.

All actions of the Company in relation to any information that is the User’s personal data are carried out in accordance with the Delaware law.

3. Reliability of the User’s information

The Company does not verify the accuracy of the information provided by the Users and does not verify the Users` legal capacity; the Company assumes that the information provided by the Users is accurate and reliable.

The User is solely responsible for the accuracy of the provided information. It is forbidden to indicate false information and information of third parties. The User’s Account can be deleted by the Company without notifying the User and at its discretion if the User violates the terms of this Privacy Policy without the User’s right to recover any damages from the Company.

4. Use of the information provided by the User

The User agrees that the Company can use the Users’ information, including but not limited to the personal data, for the following purposes:

— To personalize the use of the Mobile Application by the User;
— To improve the work of the Mobile Application;
— To communicate with the User;
— To provide the User with information, including but not limited to the advertising purposes;
— For other purposes not prohibited by law.

The Company does not sell, exchange or lease User information. The company may provide general aggregated demographic data unrelated to personal data to partners and advertisers for the purposes described above.

5. Protection of the information provided by the User

The Company takes appropriate security measures to collect, store, and process User information not specified by the User in the Account to protect it from unauthorized access, modification, disclosure, or destruction.

The Company is not responsible for the use of the User’s information specified in the Account by other Users.

The Company is not responsible if other persons gain access to the User`s Account through no fault of the Company. The User is responsible for the safety of the User`s mobile device, the confidentiality of access to the User`s social networks through which access to the Mobile Application is gained, and other actions that may entail access to the User’s Account by other persons.

6. Consent to the terms of the Privacy Policy and their changes

By registering with the Mobile Application and becoming a User, you express your specific and informed consent to the Privacy Policy. If you do not agree with the terms of the Privacy Policy, please do not proceed with the registration.

The company has the right at any time and at its own discretion to change the terms of the Privacy Policy. In such case, the updated version with changes in the terms of the Privacy Policy will be posted in the Mobile Application; you will be informed about the changes via an email sent to your email address specified by you during registration. Use of the Mobile Application after changes to the terms of the Privacy Policy will be regarded as your full acceptance of the changes.
